| WA-LG01922024 | The Strata Titles Act 1985 (STA) is the legislation that provides for the subdivision of land by strata titles schemes in WA, the creation of strata titles, and the governance and operation of these schemes. All strata properties in WA are subject to the STA. Amendments were made to the STA in 2020 and these were the most significant updates to WA’s strata law in over 20 years. These amendments introduced a range of reforms to make strata clearer and fairer for strata owners, residents, and industry professionals across the state. In accordance with section 227 of the STA, a review of the STA (the review) is to be undertaken on every fifth anniversary of the commencement of the Act. The review is scheduled to be undertaken in 2024 for delivery a report on the review in the second quarter of 2025. The review must consider the effectiveness and operation of the STA but will also aim to evaluate the effectiveness of 2020 amendments and explore improvements to professional standards for strata managers, strata company governance, costs of living in strata, among other targeted issues requiring consultation and research. In order to inform the review of the STA it is critical to capture the issues impacting key stakeholders as well as an unfiltered view of the perspectives of these stakeholders and other special interest groups with respect to the focus areas of the review. To achieve this, Landgate is undertaking a program of targeted stakeholder consultation involving interviews of stakeholders relevant to the scope of the review. Two consultations will be conducted, the first consultation (June 2024) will be based around an issues paper and provide an opportunity for stakeholders to identify issues with the operation and effectiveness of the STA. The second consultation (September/October 2024) will be based on a discussion paper and focus on legislative reform solutions for the issues identified in the first round. Outside of this targeted stakeholder engagement, there is also a need to undertake a broader program of public consultation. This broader program would follow the approach of and be held concurrently with the two phase targeted consultation.
